NYS WORKPLACE VIOLENCE PREVENTION TRAINING REQUIREMENTS

What New York employers must do now, and how D5 helps you get compliant.

New York State has made workplace violence prevention a legal obligation, not a best practice. Three separate mandates now cover healthcare facilities, retail employers, and public sector agencies. Each one requires written prevention programs, risk assessments, and staff training. D5 Consulting Group delivers all three.

HOSPITALS AND NURSING HOMES: SENATE BILL S5294-B

Signed into law on December 12, 2025, S5294-B requires every general hospital and nursing home in New York to establish a formal workplace violence prevention program. This is not a recommendation. It is an enforceable requirement under the Public Health Law.

What the law requires:

- A written, facility-specific workplace violence prevention program aligned with CMS emergency preparedness and patient safety regulations

- An initial workplace safety and security assessment, followed by annual hazard assessments to identify violence threats specific to your facility, your patient population, and your physical environment

- A safety and security plan that addresses the threats your assessment identifies

- Staff training as part of the program

- Trained security personnel for hospitals with emergency departments, with physical presence requirements near or within the emergency department

Key dates are approaching fast. Additional hospital requirements take effect January 1, 2027, and programs must be fully established by September 2027. Facilities that wait until 2027 to start will be competing for a limited pool of qualified assessors and trainers.

The assessment requirement is a performance standard. That means the law expects qualified professionals to conduct it, not an internal checklist exercise.

RETAIL EMPLOYERS: THE NY RETAIL WORKER SAFETY ACT

New York retail employers with 10 or more retail employees are already required to maintain a written workplace violence prevention policy and deliver prevention training. Training has been mandatory since June 2025, with larger employers training annually. Employers with 500 or more retail employees in New York face additional silent response button requirements as of 2026.

If your retail organization has not yet delivered compliant training, you are already behind the requirement, not ahead of a deadline.

PUBLIC EMPLOYERS: NY LABOR LAW SECTION 27-b

New York public employers have long been required to evaluate workplace violence risks, develop written prevention programs, and train employees. Schools, county agencies, and municipal employers fall under this framework. If your program exists on paper but your training is stale, you carry the risk without the protection.
